Here is the truth about the buzz word 'Buyer's Agent' - When there are two agents involved the the transfer of a property, the agent that represents you is your agent or a 'buyers' agent'. Because of the nature of the business, most listing agents do not sell their own listings. So, in every case of that nature there is a buyers' agent and a sellers' agent. Exclusive buyers' agents do exist but think about this: when an agent is offered a $300,000 home listing do you think that they are going to turn down that business? No. We started as exclusive buyers agents but found that so many people liked our services we were getting offers to list property - as a company you would have to be a fool to turn down listings that you were offered because you did a good job. The bottom line is that you are most likely not going to run into a situation where your agent that is showing you homes is, by chance, going to have listed the perfect home for you. It just does not happen and when it does - it's sort of an aberration. Most listing agents only have just a few personal listings and this situation is not something to be concerned with - it's more important that you have absolute trust in your representation. By law it's an agents fiduciary responsibility to do their absolute best for you as a client... but the speed limit is also 65 and we all know how many people obey that law; unfortunately the 'greed factor' comes into play. Comfort and trust, knowing that you believe a person has your best interests in mind will be your best choice for protection. People holding themselves out a buyers agent can also be totally inaccurate. 'Agents' must work for brokers. The broker is officially the person who is responsible for the listing and entire transaction. If a broker has two agents, one lists a home, and your agent (the other agent) shows you the home (and and works for the same broker) can not a buyers' agent because they work for the same broker - effectively the agent only represents the broker and if both agents work for the same broker, even though one has listed the home and one is your personal agent - the fact is that they both work for the same broker - in the true sense - they are not a buyers' agent. The broker is in charge, the broker is considered the one who is responsible. A true buyers agent would have to be a broker who absolutely does not take any listings or an agent who works for a broker who does not take any listings. In most situations, unless you call the listing agent directly for a particular home, you will be working with someone who will most likely be your agent.
